Terms of Service
Please read these terms of service carefully before using MotionLife's active recreation services in Canada. By booking any adventure or workshop with us, you agree to be bound by these terms.
1. Service Agreement
MotionLife provides guided outdoor recreation services including but not limited to mountain trekking, whitewater rafting, winter expeditions, and skill development workshops throughout Canada. By participating in our services, you acknowledge that outdoor activities involve inherent risks and agree to follow all safety guidelines provided by our certified instructors.
Our adventure packages include professional guides, safety equipment, and educational components as specified in each program description. All participants must meet age and fitness requirements outlined for each specific activity before booking confirmation.
2. Booking and Payment Terms
Reservations for all MotionLife adventures must be made through our official booking system or by contacting our customer service team directly. A non-refundable deposit of 25% is required to secure your booking, with full payment due 30 days before your adventure start date.
Accepted payment methods include major credit cards, bank transfers, and certified checks. All prices are listed in Canadian dollars (CAD) and include applicable taxes unless otherwise specified. Group discounts and early bird pricing may be available for select programs.
- Deposit required: 25% of total program cost
- Final payment due: 30 days before start date
- Late payment fees: $50 CAD after 5-day grace period
- Currency: All transactions in Canadian dollars
3. Cancellation and Refund Policy
We understand that plans can change. MotionLife offers flexible cancellation policies based on advance notice provided. Cancellations made more than 60 days before your adventure start date are eligible for full refund minus the deposit. Cancellations between 30-60 days receive 75% refund, while cancellations within 30 days are non-refundable.
In cases of extreme weather conditions, natural disasters, or other circumstances beyond our control, MotionLife reserves the right to cancel or postpone adventures. In such cases, participants will receive full refund or opportunity to reschedule at no additional cost.
Refund Schedule:
- 60+ days: Full refund minus deposit
- 30-60 days: 75% refund
- 15-30 days: 50% refund
- Under 15 days: No refund
4. Safety Requirements and Liability
Participant safety is our highest priority. All clients must complete a comprehensive health questionnaire and liability waiver before participating in any MotionLife adventure. Participants with certain medical conditions may be required to provide physician clearance before being accepted into programs.
While MotionLife maintains comprehensive insurance coverage and employs certified guides with wilderness first aid training, participants acknowledge that outdoor activities carry inherent risks including but not limited to injury, illness, or in extreme cases, death. Participants assume all risks associated with their chosen activities.
Required Documentation:
- Signed liability waiver and medical questionnaire
- Emergency contact information
- Proof of travel/health insurance (recommended)
- Government-issued photo identification
- Medical clearance (if required by program)
5. Equipment and Personal Property
MotionLife provides all specialized safety equipment and technical gear required for each adventure as outlined in program descriptions. Participants are responsible for bringing appropriate personal clothing and any recommended personal items listed in pre-trip communications.
While we take reasonable precautions to protect participant belongings, MotionLife is not liable for loss, theft, or damage to personal property during adventures. We strongly recommend participants carry appropriate travel insurance to cover personal belongings and potential trip interruptions.
6. Code of Conduct
All MotionLife participants are expected to conduct themselves in a respectful manner toward fellow adventurers, guides, and the natural environment. Behavior that endangers others, damages equipment, or violates Leave No Trace principles may result in removal from the program without refund.
Use of alcohol or recreational drugs during MotionLife programs is strictly prohibited. Participants found to be under the influence will be immediately removed from the program for safety reasons. Tobacco use is permitted only in designated areas and never during active program hours.
7. Photography and Media Release
MotionLife reserves the right to photograph and video record program activities for marketing, educational, and promotional purposes. By participating in our programs, you grant MotionLife permission to use your likeness in photographs, videos, and other media without compensation.
If you prefer not to be photographed or filmed, please notify your guide at the beginning of your program. We will make reasonable efforts to accommodate this request while still documenting the overall program experience.
8. Environmental Responsibility
MotionLife is committed to sustainable outdoor recreation practices. All participants must follow Leave No Trace principles and respect wildlife viewing guidelines. Littering, harassment of wildlife, or damage to natural areas may result in immediate program dismissal and potential legal action.
We operate under permits issued by Parks Canada and provincial authorities. Violation of park regulations or permit conditions by participants may result in fines or legal consequences for which the individual participant is fully responsible.
9. Force Majeure
MotionLife shall not be liable for any failure to perform due to unforeseen circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather conditions, government restrictions, labor disputes, or other acts of God that make program delivery unsafe or impossible.
In force majeure situations, we will work with participants to reschedule programs when possible or provide appropriate refunds based on the specific circumstances and timing of the event.
10. Dispute Resolution and Governing Law
These terms of service are governed by the laws of Canada and the province in which the program takes place. Any disputes arising from MotionLife programs shall be resolved through binding arbitration in accordance with Canadian arbitration procedures.
Prior to initiating formal dispute resolution, both parties agree to attempt resolution through good faith negotiation. MotionLife is committed to addressing participant concerns promptly and fairly through direct communication when possible.
11. Modifications to Terms
MotionLife reserves the right to modify these terms of service at any time. Updated terms will be posted on our website and participants will be notified of significant changes via email. Continued use of MotionLife services after terms modifications constitutes acceptance of the revised terms.
